General Terms of Use

Agreement to General Terms of Use

 

1. Your general use of this website and the 25Hours App (collectively, the “Website”) is subject to the General Terms of Use (including our Privacy Policy) (collectively, the “TOU”). Please note that by visiting, accessing and using this Website, you will be deemed to have accepted the TOU and to be legally bound by the TOU. If you do not agree to the TOU, please do not visit, access, and/or use this Website.
 

2. The TOU may be changed from time to time at the sole discretion of 25Hours and your continued use of the Website shall constitute acceptance of the TOU as may be revised from time to time. As such please regularly check the TOU.
 

3. The use of specific parts of the Website and/or specific services found in the Website may be subject to further specific terms and conditions.

Ownership of Website and materials on Website

4. The Website is owned and maintained by 25Hours.
 

5. All materials on this Website (including information, images, videos and text) (the “Materials”) are subject to copyright and trade mark laws and other forms of intellectual property rights and are the property of either 25Hours or their respective intellectual property right owners.
 

6. You may only use the Materials, to the extent that the Materials are necessary for accessing the Website and the services provided on the Website by 25Hours.

 

7. Except as expressly provided in the TOU, no part of the Website and no Materials may be used, modified, reproduced, republished, posted, transmitted or distributed in any way without the prior written consent of 25Hours.

 

8. The reproduction, republishing, posting, transmission, distribution, modification, or unauthorised use of the Materials will be a violation of the owner of the copyright and/or other intellectual property rights. You may face civil and/or criminal liability for such a violation.

 

 


Privacy Policy

9. The privacy of your personal information is important to us. The terms of our Privacy Policy as amended from time to time are incorporated into the TOU by reference. Please carefully read our Privacy Policy, which explains our data use and privacy practices in detail.

 

 


Access to the Website and Content of the Website

This Website may occasionally be taken off-line as and when deemed necessary by 25Hours (including, but not limited to, for the purposes of website maintenance). 25Hours may also at any time also deny or restrict access to this Website, without the need to provide any notice or reasons whatsoever for the denial or restriction.

11. 25Hours does not make any warranty that the Website shall always be accessible to you, or that your access will be error-free, uninterrupted, or that the Website and any files or other data downloaded from the Website will be free of all viruses and other harmful software.

 

12. The Materials provided on this Website are provided on an “as is” basis, and 25Hours does not, to the full extent permitted by law, make any warranty (express or implied) that the Materials are accurate, timely, merchantable, and/or fit for any particular purpose.  25Hours may change any or all of the Materials without any notice.

13. 25Hours will not be responsible for any damage that you may suffer as a result of the use of this Website and the Materials, including any inability to access the Website, any reliance on the accuracy of the Materials and any viruses or harmful software acquired as a result of accessing the Website and the Materials.

Permitted use of this Website

14. You may only use this Website to the extent necessary for accessing the Website and/or the services offered on or through the Website by 25Hours. Except as expressly provided in the TOU, the use of this Website in any other way shall constitute unauthorised use and 25Hours reserves the right to deny or restrict such unauthorised use, which includes but is not limited to:
 

     a. the use of any computer program, algorithm or methodology (whether automated or manual), to access, copy, compile information, monitor

         any part of this Website, or to bypass the security measures of the Website;

 

     b. the transmission via or through the Website of any information, data, text, images, files, links, or software other than for purposes expressly

         provided in the TOU or with the prior written consent of 25Hours;

 

     c. the introduction to the Website of any virus, malicious programs, and/or harmful code (howsoever named);

 

      d. the impersonation via this Website of any person, including other registered users or an employee of 25Hours;

 

     e. the violation of any personal or propriety right; and

 

     f. acts of misrepresentation and/or fraud. 


15. 25Hours shall have the right at all times to delete or edit all material which it deems to be in connection with any of the matters set out at paragraph 14 above, or that which is otherwise appropriate.

     b. advertisements;

     c. personal and/or confidential information which you are not authorised to post, transmit or otherwise send;

     d. spam;

     e. material which infringes intellectual property rights; and

     f. information and/or material of a similar nature to the above.

Governing Law and Jurisdiction

22. This TOU and all matters relating to your access to, or use of, the Website shall be governed by and construed in accordance with the laws of Singapore and you hereby submit to the non-exclusive jurisdiction of the Singapore courts.

25Hours Membership Terms and Conditions​

​

Access to services on the 25Hours App will only be available to members of 25Hours (“Members and each, a “Member”). Use of the 25Hours App is subject to the Membership Terms and Conditions (“T&Cs”) and the General Terms of Use (“TOU”) which are hereby incorporated by reference into these T&Cs.

​

A. Membership Application

 

1. Applications for a membership with 25Hours (“Membership”) may be submitted by interested parties (“Applicants”) for review, by filling in an Interest Form (“IFOM”) via the following link: https://itsabouttime.25hrs.com/register. After a review process, the Applicant will be sent an On-Boarding Form (“OFOM”) to select the preferred membership payment plan (ANNUAL or MONTHLY) for sign-up. The Applicant may provide his/her credit card details in the OFOM for 25Hours to process payment. Please note that Membership will be granted, and you shall be deemed a Member, only upon successful payment of the applicable Membership fee.

2. Your submission of an IFOM and OFOM to become a Member indicates your offer to become a Member upon these T&Cs and the TOU. 25Hours reserves the sole and absolute right to accept such offer. If 25Hours accepts such offer, we will notify you by sending an acceptance email to your registered e-mail address, upon which a binding agreement shall form between 25Hours and you (the Member) upon these T&Cs. For avoidance of doubt, your submission of an application to become a Member shall be deemed as acceptance of these T&Cs and the TOU.
 

3.The T&Cs may from time to time be amended by 25Hours without notice to you, and your continued status as a Member shall be deemed to be acceptance of any such amendment. 25Hours may, at its discretion, inform you of material changes to the T&Cs. If you disagree with the T&Cs and/or any amendments made thereto, please terminate your Membership immediately. Details on how to terminate your Membership are provided at Section C below.

 

4. When you submit an IFOM and OFOM to become a Member, you warrant and represent that all information provided is accurate, complete, and current as of the date of the forms. Failure to do so may result in a rejection of your application, or where Membership has already been granted, the termination of your Membership, and/or the termination of any transaction involving Membership Benefits (defined below). Your responsibility to provide accurate information is a continuing obligation and you must notify 25Hours in the event that any information provided by you has changed.
 

5. The submission of the IFOM and OFOM shall also be deemed to be your consent to receiving all forms of communication from 25Hours for matters relating to, and arising from, your membership.

B. Membership Account

 

6. Your Membership is personal to you. It is non-transferable and you may not use your Membership to obtain benefits on behalf of another person who is not a Member.  You are responsible for ensuring that no one else uses your Membership.
 

7. Access to and use of the 25Hours App via a username and password is reserved exclusively for Members. You are solely responsible for maintaining the confidentiality of your username and password and you agree to notify 25Hours immediately if you believe that there has been any breach of security (e.g., the unauthorized use of your username and password). You shall not at any time disclose your password to any third party.
 

8. You will have a digital Membership card which will allow you to access the various features of your membership.  You agree that you will only use your Membership card for the purposes for which it is issued.

C. Membership Fees, Terms, Upgrade/Downgrade, Change of Subscription Plan, and Termination

 

9. Members who opt-in to any of the subscription payment plans will continue to make recurring payments to access their membership. Upon 25Hours’s acceptance of the OFOM, once the set-up (opt-in) is successfully completed on the Member’s credit card, payments shall be charged automatically to the primary credit card registered on the 25Hours App, until the Member initiates a cancellation to the subscription.
 

10. Membership fees shall be communicated to you after review of your IFOM. The type of subscription plan and the corresponding fees will be selected by you when completing the OFOM.
 

11. All payments of Membership fees will be handled via credit card, in a manner in substance similar to Section G (Payments and Use of Credit Card) below.
 

12. Your Membership fee is non-refundable. However, 25Hours may at its sole discretion elect to refund your Membership fee in whole or in part depending on the circumstances relating to the termination of your Membership.

Membership Term

​

13. "Membership Term" is the period of time in which you are a Member. Membership starts on the date of successful payment upon the submission of the OFOM. Members’ "Membership Account Status" shall only be updated to "Activated" when the "Invoice Status" is "Paid”, and the "Subscription Status" is "Active".  The date when the membership first becomes “Active” will be the “Anniversary Date” of the member (applicable for both monthly and annual types of membership).

Membership Conversion

 

14. A Member may convert its Membership from one subscription plan to another (i.e. annual subscription to monthly subscription and vice versa).
 

15. For converting a Membership from a monthly subscription to an annual subscription, the Member will have to make payment for the annual membership fees. Once payment is successful, the Membership will be changed to annual upon completion of the current term. Upon successful change, a Member may not initiate a new change or cancellation within the same membership term; it may only be from the anniversary date onwards.
 

16. For converting a Membership from an annual subscription to a monthly subscription, the monthly membership fee shall only be charged at the end of the member's current membership term(annual). Upon successful change, a Member may not initiate a new change or cancellation until the same membership term; it may only be from the anniversary date onwards.
 

17. Upon payment of the applicable Membership fee, 25Hours will give or continue to give (as the case may be) the Member access to the 25Hours App.

Cancellation/Termination

​

18. 25Hours reserves the absolute right to terminate or suspend your Membership (at its sole discretion) for any reason whatsoever, including but not limited to a breach of the T&C and/or where your Membership fee has remained due and unpaid for a period of more than 7 calendar days.
 

19. If you wish to terminate your Membership, you may do so by providing 1 months’ notice via email to 25Hours.
 

20. In the event that your Membership is cancelled/terminated, all provisions in the T&Cs pertaining to confidentiality, disclaimers, personal information, and indemnity and limitations of liability shall continue to apply. For the avoidance of doubt, the TOU shall continue to apply to your general use of the Website.

D. Membership Benefits

 

21. As a Member, you will be able to access the Member Benefits (defined below) set out on the 25Hours App (including but not limited to discounts, preferential rates, and other perks). A dedicated membership hotline (during business hours) shall be provided to the Members for enquiries and booking of the services and benefits, the details of which shall be stated on the 25Hours App.
 

22. “Members Benefits” shall include:

     a. Access to the eStore and the ability to purchase goods on the eStore (collectively “goods”). Please see Section E and/or the relevant parts of

         the 25Hours App for the specific terms and conditions on the use of the eStore.
 

     b. Access to services, including travel services provided by 25Hours as a registered travel agent (collectively “services”). Please see the relevant

         part of these T&Cs and/or the relevant parts of the 25Hours App for the specific terms and conditions for such services; and
 

     c. Other benefits, including discounts at third party suppliers (collectively “benefits”). The details and terms of such benefits will be specified by

         25Hours on the 25Hours App and/or via email to you.
 

23. You hereby acknowledge that some Members Benefits are provided by third-party suppliers (“Suppliers”) and that the supply of such Members Benefits is subject to availability and may change from time to time without prior notice. The Suppliers may also have their own terms and conditions which may affect the availability and/or quality of the relevant Members Benefits. 25Hours shall not be liable for  any damage you may suffer as a result of the unavailability of any Membership Benefits, and you hereby irrevocably waive any claim against 25Hours with respect to such unavailability of Membership Benefits.
 

24. For the purposes of giving you access to the Members Benefits provided by such the Suppliers, 25Hours will generally communicate with the Suppliers on your behalf. However, there may be situations where it is more appropriate for you to contact the Suppliers directly, and 25Hours will inform you when this is necessary.
 

25. 25Hours is committed to using all reasonable efforts to ensure that the Members Benefits remain available at all times. If any of the Members Benefits become unavailable, we will do all we reasonably can to ensure that prior commitments with you are honored to the fullest extent possible but shall not be responsible for any actions of Suppliers.
 

26. 25Hours may from time to time discontinue Members Benefits. In the event that you are affected by the withdrawal of any such Member Benefit, 25Hours will inform you as soon as reasonably practicable.

E. Use of eStore

 

27. As a Member, you shall also have access to the eStore on the 25Hours App. Without prejudice to the generality of the other provisions in the T&Cs, the provisions of this part shall apply to the use of the eStore.
 

28. Some goods on the eStore will be sold directly to you by 25Hours (“25Hours Goods”). In the case of 25Hours Goods, you may place an order for such 25Hours Goods by providing the relevant details and clicking on the “Buy Now” or “Add To Cart” button to submit your order. All orders of 25Hours Goods are irrevocable upon submission and by doing so, you confirm that the details contained in your submitted order are correct in all aspects. If the order is confirmed, we will notify you by sending a confirmation email to your registered e-mail address, upon which a binding agreement shall form between 25Hours and the Member upon these T&Cs and such other specified terms for the sale and purchase of such 25Hours Goods. Notwithstanding the generality of the foregoing, 25Hours reserves the right, at any time, to reject your order for any reason whatsoever.
 

29. Some goods on the eStore will be provided by Suppliers (“Supplier Goods”). In the case of Supplier Goods, you may place an order for such Supplier Goods by providing the relevant details and clicking on the “Buy Now” or “Add To Cart” button. All orders of Supplier Goods are irrevocable upon submission and by doing so, you confirm that the details contained in your submitted order are correct in all aspects. If the order is confirmed, 25Hours will send a confirmation email to your registered e-mail address, upon which a binding agreement shall form between you and the relevant Supplier for the sale and purchase of such Supplier Goods.
 

30. 25Hours Goods and Supplier Goods will be clearly marked as such on the 25Hours App.
 

31. You acknowledge that while 25Hours takes all reasonable efforts to ensure that the information in the eStore is complete and reliable, the information may still contain typographical errors, omissions, pricing errors, and other errors or inaccuracies. For avoidance of doubt, any such errors, and/or inaccuracies shall not be binding. Notwithstanding the aforesaid, 25Hours shall take all reasonable effort to correct any such errors and/or inaccuracies as soon as practicable.
 

32. Goods may differ slightly from the images shown although every effort is made to ensure that all descriptions are as accurate as possible. In the case of Supplier Goods, the descriptions of such goods and services are provided by that Supplier. 25Hours is not responsible for inaccurate or misleading descriptions of Supplier Goods.
 

33. 25Hours reserves the right to:

     • revoke any stated offer affected by such errors.

     • correct any such errors.

     • make changes to prices, content, promotion offers, goods descriptions or specifications, or other information affected by the errors, without any

       obligation to issue any notice of such changes.
 

34. In the case of Supplier Goods, you acknowledge and agree that your purchase of the same is always subject to the Supplier’s terms and conditions including such terms governing cancellation, exchange and/or refunds for your intended purchase and/or purchase. 25Hours disclaims any and all liability, including any express or implied warranties, for the Supplier Goods. You acknowledge that no representation has been made by 25Hours as to the fitness or quality of the Supplier Goods for your intended purpose.

 

35. You acknowledge that Goods purchased from the eStore may be shipped to you via a third-party carrier, and that all risk of loss and title to the goods shall pass to you upon 25Hours’s delivery of such goods to such third-party carrier. Unless expressly provided for, 25Hours shall not be responsible for any damage, delay, or loss of the goods during delivery arising from the actions of the carrier. For the avoidance of doubt, in the case of Supplier Goods, 25Hours shall not be responsible for any damage, delay or loss of the goods during the delivery of such Supplier Goods to you.
 

36. Goods purchased from the eStore may also be delivered to you via alternative means (e.g., self-collection). Where applicable, such alternative means will be specified directly on the relevant page of the eStore, and your purchase of the good shall be deemed to be acceptance of such alternative means of delivery.

F. 25H Points

​

37. Each completed purchase on the eStore and the 25Hours App may make you eligible to receive reward points (“25Hours Points”) in your Membership account, which may be used to obtain certain rewards, the details of which shall be specified from time to time by 25Hours. 25Hours Points are not transferable or refundable and cannot be combined with 25Hours Points belonging to other persons. You may not, at any time, purchase, sell or barter any 25Hours Points to any person in exchange for cash. 25Hours Points are also not redeemable for cash. 25Hours reserves the right to cancel or terminate, without refund, the Membership of any member who is found to have been in breach of this term.
 

38. 25Hours Points may be redeemed by a Member to offset 25Hours eStore payment amount on selected items (as may be indicated on the eStore). 25Hours Points cannot currently be used to offset payments for hotel bookings, membership fees/renewals*, and other items where indicated. *Renewal here means the continuation of membership subscription.
 

39. For eStore purchases, 25Hours Points are credited into the Member’s account within 5 calendar days after delivery.
 

40. For hotel bookings, 25Hours Points are credited into the Member’s account within 1 calendar week after hotel checkout date.
 

41. Subject to the expiration or termination (as the case may be) of the Membership, upon which anycredited but unused 25Hours Points shall expire on such date of expiration or termination (as the case may be) without any compensation, all credited 25Hours Points will expire 1 year from the date of the most recent crediting of 25Hours Points into the Member’s account]. For example, 100 25Hours Points credited to an account on 16th May 2022 will expire on 15th May 2023. Notwithstanding the generality of the foregoing, if the Membership expires or is terminated prior to 15 May 2023, and such Membership is not renewed, the 100 25Hours Points (or any portion thereof unused) will expire from the date of expiration or termination of Membership without any compensation thereto.
 

42. We illustrate using hypothetical scenarios below:

Scenario A – New Member Onboarding with No Further Transactions & Renewals

     • A new 25Hours member successfully makes payment for his/her on-boarding (first) membership fee on 1st February 2022. His/her

       membership account is successfully activated on the same day (1st February 2022).

     • Assuming there is no membership sign-up related campaign in place, his/her initial 25Hours Points balance will be 0.00.

     • Assuming if the same member does not make any other transactions with 25Hours thereafter, there is no expiration to his/her 25Hours Points

       balance as the value is 0.00.
 

Scenario B – New Member Onboarding with Manual Awarding Of 25H Points

     • A new 25Hours member successfully makes payment for his/her on-boarding (first) membership fee on 1st February 2022. His/her

       membership account is successfully activated on the same day (1st February 2022).

     • As part of a membership sign-up related campaign, the member shall be credited two hundred 25Hours Points (200.00) within three (3)

       business days.

     • Assuming Membership Services team manually creates a new member loyalty transaction for the same member in the system on 3rd February

       2022, the member’s 25Hours Points balance expiration will be set to 2nd February 2023 in the system as well.

     • Assuming if the same member does not make any other transactions with 25Hours thereafter, his/her 25Hours Points balance (200.00) shall

       expire on 2nd February 2023 (i.e. actual date member loyalty transaction + 365 calendar days).

     • Note that the member will not be able to continue to access his/her membership account after 31st January 2023, if he/she does not renew the

       membership.
 

Scenario C – New Member Onboarding with Single Transaction But No Renewals

     • A new 25Hours member successfully makes payment for his/her on-boarding (first) membership fee on 1st February 2022. His/her

       membership account is successfully activated on the same day (1st February 2022).

     • Assuming there is no membership sign-up related campaign in place, his/her initial 25Hours Points balance will be 0.00.

     • Assuming that the same member successfully makes a property booking (“pay now”) or eCommerce order that earns him/her ninety-five

       25Hours Points (95.00) via the systems on 21st February 2022, and that the systems automatically credit the ninety-five 25Hours Points (95.00)

       to his/her balance on 30th March 2022. From 30th March 2022 and onwards, he/she will have ninety-five 25Hours Points (95.00) available to

       be used for future transactions with 25Hours.

     • Assuming if the same member does not make any other transactions with 25Hours thereafter, his/her 25Hours Points balance (95.00) shall

       expire on 29th March 2023 (i.e. actual date of member loyalty transaction + 365 calendar days).

     • Note that the member will not be able to continue to access his/her membership account after 31st January 2023, if he/she does not renew the

       membership.
 

Scenario D – New Member Onboarding with Multiple Transactions But No Renewals

     • A new Singapore member successfully makes payment for his/her on-boarding (first) membership fee on 1st February 2022. His/her      

       membership account is successfully activated on the same day (1st February 2022).

     • Assuming there is no membership sign-up related campaign in place, his/her initial 25Hours Points balance will be 0.00.

     • Assuming that the same member successfully makes a first property booking (“pay now”) or eCommerce order that earns him/her ninety-five

       25Hours Points (95.00) via the systems on 21st February 2022, and that the systems automatically credit the ninety-five 25Hours Points (95.00)

       to his/her balance on 30th March 2022. From 30th March 2022 and onwards, he/she will have ninety-five 25Hours Points (95.00) available to

       be used for future transactions with 25Hours.

     • Assuming that the same member successfully makes a second property booking (“pay now”) or eCommerce order, without utilizing any of

       his/her existing balance, that earns him/her another twenty-five 25Hours Points (25.00) via the systems on 1st May 2022, that the systems

       automatically credit the additional twenty-five 25Hours Points (25.00) to his/her balance on 30th May 2022. From 30th May 2022 and

       onwards, he/she will have a total of one hundred and twenty 25Hours Points (120.00) available to be used for future transactions with 25Hours.

     • Assuming if the same member does not make any other transactions with 25Hours thereafter, his/her 25Hours Points balance (120.00) shall

       expire on 29th May 2023 (i.e. actual date of last member loyalty transaction + 365 calendar days).

     • Note that the member will not be able to continue to assess his/her membership account after 31st January 2023, if he/she does not renew the

       membership.
 

Scenario E – New Member Onboarding with Multiple Transactions & Renewal

     • A new 25Hours member successfully makes payment for his/her on-boarding (first) membership fee transaction on 1st February 2022. His/her

       membership account is successfully activated on the same day (1st February 2022).

     • Assuming there is no membership sign-up related campaign in place, his/her initial 25Hours Points balance will be 0.00.

     • Assuming that the same member successfully makes a first property booking (“pay now”) or eCommerce order that earns him/her ninety-five

       25Hours Points (95.00) via the systems on 21st February 2022, and that the systems automatically credit the ninety-five 25Hours Points (95.00)

       to his/her balance on 30th March 2022. From 30th March 2022 and onwards, he/she will have ninety-five 25Hours Points (95.00) available to

       be used for future transactions with 25Hours.

     • Assuming that the same member successfully makes a second property booking (“pay now”) or eCommerce order, without utilizing any of

       his/her existing balance, that earns him/her another twenty-five 25Hours Points (25.00) via the systems on 1st May 2022, that the systems

       automatically credit the additional twenty-five 25Hours Points (25.00) to his/her balance on 30th May 2022. From 30th May 2022 and

       onwards, he/she will have a total of one hundred and twenty 25Hours Points (120.00) available to be used for future transactions with 25Hours.

     • Assuming if the same member renews his/her membership and successfully makes payment for his/her membership renewal fee on 28th

       December 2022. The expiration of his/her membership account will be extended to 31st January 2024.

     • Assuming if the same member does not make any other transactions with 25Hours thereafter, his/her 25Hours Points balance (120.00) shall

       expire on 29th May 2023 (i.e. actual date of member loyalty transaction + 365 calendar days).

     • Note that the member will not be able to use his/her 25Hours Points balance (120.00) after 29th April 2023, even though his/her membership

       account has been extended to 31st January 2024 via the successful membership renewal.
 

43. 25Hours Points are valid for the country where your membership is registered and available for usage under its currency. 
 

44. 25Hours Points are awarded based on the amount spent on the Company’s listed services and/or products, excluding taxes, special gift voucher purchase, credit card charges, administrative charges or the like.
 

45. 25Hours Points will not be reinstated or extended under any circumstances once expired.
 

46. Upon membership expiry or termination (as the case may be),  25Hours Points in the account will be immediately void/expired.
 

47. 25Hours Points will only be awarded to a valid and existing/active 25Hours Member, who may only use the 25Hours Points under his own Membership account.
 

48. Notwithstanding anything in these T&Cs,  25Hours Points are only rewarded and operated by 25Hours and 25Hours has the full discretion on rewarding, revoking, and forfeiting 25Hours Points.
 

49. 25Hours reserves the right to revise, suspend, or terminate any promotional event or discount without further notice.

G. Payment and Use of Credit Card

 

50. Unless otherwise provided for, all payments made in connection with your Membership (including payments for purchases on the eStore, and the use of 25Hours's travel and restaurant services) shall be by way of credit card and shall become due upon confirmation of your order by 25Hours or the Supplier (as the case may be).
 

51.  In respect of each payment in respect of the membership fees, in the event of a failed or declined payment via the credit card, you authorize 25Hours to make subsequent attempts to process the payment until such payment is successful.  In the event that 25Hours is unable to process payment successfully despite 2 attempts, 25Hours shall inform you in writing and you shall effect payment within two (2) days of such notice, failing which your Membership shall be terminated with immediate effect.
 

52. You shall at all times be responsible for the safekeeping of particulars of your credit cards and unless we are expressly informed otherwise you shall be deemed the authorised cardholder and/or payment account holder for the purposes of making payments for purchases made via the eStore. Any information provided by you for the purposes of making payments for purchases via the eStore are to be treated in such a manner whereby you are the authorised cardholder and/or payment account holder.
 

53. You undertake to ensure that all details you provide to us for payment are correct, and that there are sufficient funds to cover the cost of the goods or services being purchased. In the event that you suspect unauthorised use of your credit card, or any unauthorised payment made thereto, you shall be liable for contacting the issuing bank. For the avoidance of doubt, 25Hours shall, to the extent possible under the law, not be responsible or liable for any loss or damage arising from fraudulent transactions involving your credit card. 25Hours expressly reserves the right to immediately cancel, delay, or recall any good, benefit, or service if there is reason to believe that it is a fraudulent transaction.
 

54. 25Hours may, at your written instructions, purchase goods or services via the eStore on your behalf. In such an event, you hereby authorize 25Hours to deduct the credit sum (inclusive of any applicable fees) from your credit card within 30 days of the date of 25Hours’s payment of the relevant goods or services. In such an event, you shall be deemed to have requested and authorized 25Hours to use your credit card for payment, and you acknowledge and agree that 25Hours shall have no liability or be responsible in any way whatsoever in respect of the use of your credit card provided that 25Hours acts in accordance with the written instructions issued by you in relation thereto.
 

55. In the event that you have ordered goods or services which are supplied by a Supplier, 25Hours does not guarantee and shall not be responsible for any refunds should such goods and services be cancelled.
 

56. You acknowledge that the price of certain goods and services offered on the eStore is an estimate only (e.g., where certain goods are affected by seasonal pricing), and that the actual price of the good or service may be different. Such goods will be clearly marked on the eStore as having estimated prices only. Where you have agreed to purchase the good based on its estimate price, you acknowledge that you have further agreed to authorize 25Hours to deduct the full actual price from your credit card provided that the actual price is not 20% greater than the estimate.

H. Travel Related Services

​

57. Without prejudice to the generality of the other provisions of the T&Cs, the provisions of this part shall apply specifically for travel related services provided by 25Hours.
 

58. 25Hours is a licensed travel agent (travel agent license number: TBC). However, any services including travel tickets and package holidays purchased through 25Hours will be subject to the terms and conditions of the relevant travel services Supplier. For the avoidance of doubt, the terms and conditions for cancellation of and changes to bookings and purchases will vary for each service, and therefore you are advised to check with 25Hours with regard to any cancellation fees and the terms and conditions under which you are liable to pay the cancellation fee.  All rights and remedies you have are against the relevant Supplier. 25Hours disclaims any and all liability, including express or implied warranties, whether oral or written, for the services provided by any relevant travel services Supplier.
 

59. 25Hours will communicate with the travel or holiday operator and the Supplier on your behalf unless it informs you that it is more appropriate for you to contact the Supplier directly. However, please note that a minimum of 3 business days will be required, in addition to any time period required under the terms and conditions of the Supplier, relating to any booking cancellation and booking changes through 25Hours.
 

60. When you purchase any travel related services, you hereby authorize 25Hours to charge your credit card in accordance with the terms and conditions relating to payment and the use of your credit card as set out at Section G (Payments and Use of Credit Card) above.
 

61. You are advised to independently purchase the necessary travel insurance against any failure/disruption in the provision of the travel related service.
 

62. 25Hours reserves the right to assist and facilitate any request by the relevant authorities to ensure that all relevant laws and regulations are complied with, including the right to cancel, change or modify any travel tickets and package holidays purchased through 25Hours or the right to provide information regarding such travel tickets and package holidays purchased through 25Hours to the relevant authorities.

I. Restaurant and Club Services

 

63. Without prejudice to the generality of the other provisions of the T&C, the provisions of this part shall apply specifically for restaurant and club services provided by 25Hours.
 

64. When you use the restaurant booking services on the 25Hours App, you may be required to provide your credit card details to secure the reservation. By submitting your credit card details, you hereby authorize 25Hours and/or the relevant Supplier to charge your credit card accordingly for the reservation, inclusive of any cancellation charges that may arise, in accordance with Section G (Payments and Use of Credit Card) above.

J. Tickets

 

65. Without prejudice to the generality of the other provisions of the T&C, the provisions of this part shall apply specifically for tickets which may be offered to Members.
 

66. 25Hours is engaged in the business of providing Members with tickets for events either directly or through one of its ticket agent partners. Please note that you are purchasing tickets above face value, which includes service charge(s) reflecting our costs and efforts in obtaining your seats (all sums above the face value shall be henceforth referred to as “non-face value”).
 

67. All sales are final, and no refunds or cancellations will be issued after you have purchased your tickets. When you purchase any tickets from or via 25Hours, you hereby authorize 25Hours to charge your credit card accordingly for the tickets, inclusive of any charges that may arise, in accordance with Section G (Payments and Use of Credit Card) above.
 

68. In the event of show cancellations directly by the artist/promoter, 25Hours will make best efforts to obtain a refund from the artist/promoter of the face value of the ticket on your behalf. Please note that the non-face value of the ticket is not refundable. Notwithstanding the generality of the foregoing, refunds (if any) shall be made only at the artist/promoter/ticket agent’s discretion and 25Hours shall not bear any liability in the event that the artist/promoter/ticket agent’s does not offer a refund.
 

69. The purchase of tickets is subject to the relevant terms and conditions of the ticketing agents. Digital tickets will be issued via email, whereas physical tickets will be available for self-collection by Members. Alternatively, Members may opt for the dispatch of tickets via registered post, at the Member’s own cost. 25Hours will not be liable for any loss through delivery by post.
 

70. 25Hours and its ticket agent partners reserve the right to upgrade tickets at no additional cost, to downgrade tickets (partial refund) or to cancel the order with a full refund.

​

K. Return Policy

​

71. Unless explicitly provided otherwise, there shall be strictly no return and no refund for the purchase of tickets; goods that are perishable; goods that are made to your specification or are clearly personalized for you; intimates, earrings, undergarments; and/or any other goods which may be specified on the eStore as being non-returnable and/or non-refundable.
 

72. Goods which are received defective or in a damaged condition; or which have been incorrectly delivered (i.e., where a different good from the good that was ordered has been delivered) may be returned, subject to the following terms and conditions:

     • In the case of 25Hours Goods, you must inform 25Hours within 7 days of receipt of such goods in the event that the goods are defective,

       damaged, or incorrectly delivered. In the event that you do not do so, 25Hours will assume that you have received the goods in a state that

       conforms to the description of the 25Hours Goods on the 25Hours App and that are in good condition.

     • In the case of Supplier Goods, you will be required to communicate directly with the Supplier for the Supplier to process any returns request,

       which returns process shall at all times be subject to the Supplier’s prevailing terms and conditions on such subject matter.

     • In the case of Supplier Goods, the costs of returning the goods shall be the responsibility of the Supplier. 25Hours will bear the costs of returns

       of 25Hours Goods. For the avoidance of doubt, 25Hours shall not be obliged to bear the costs of returns for 25Hours Goods that are not

       eligible for returns, and in such an event, you may be asked to reimburse 25Hours for any postage incurred.

     • Goods must be in their original purchase condition, including the original packaging, manufacturer's containers, documentation, and all

       accessories. All packaging must be unmarked and not defaced in any manner.

     • Any goods that you received with tag(s) attached must be returned with the same tag(s) intact.

     • Goods purchased as part of a set or multi-item pack have to be returned as a whole set.

     • All returned Goods will be reviewed by 25Hours. Goods should also match the written or photographic documentation of their condition

       provided when requesting the return. Returned Goods that do not meet the abovementioned requirements will not be accepted and Members

       may be charged for any expenses incurred by 25Hours.

     • In the case of Supplier Goods, all returns shall be subject to the ultimate final approval of that Supplier.

     • 25Hours reserves the right to offer, in lieu of a replacement Goods, a refund in the form of 25H Points or cash, at our sole discretion.

     • Any request for a return of Goods shall take approximately 10 business days after receipt by 25Hours of the Goods to be processed. In the case

       of Supplier Goods, the processing time will depend on the Supplier.

L. Use of your Personal Data

 

73. With the submission of your registration as a Member, you acknowledge and agree that you accept the terms of our Privacy Policy, and you hereby consent that 25Hours may collect, use and disclose your personal information, as provided in the application form, for the purposes of processing your Membership application, administering your Membership with 25Hours, contacting you to provide goods and services that you requested and informing you about 25Hours related goods, services, offers and events, and contacting you for post-service feedback after utilization of 25Hours related services, amongst others, details of which are more particularly described in our Privacy Policy.

M. Reservation of Liability

 

75. 25Hours warrants to you that 25Hours shall use its reasonable endeavours to provide the membership services with reasonable care and skill, and as far as reasonably possible, in accordance with your requests and instructions. In relation to goods or services provided by a Supplier, 25Hours is acting as your agent in sourcing the goods or services. 25Hours will use reasonable care in selecting the Supplier and ensuring the order is placed in accordance with your wishes. 25Hours does not and will not provide any representations in relation to any information and suggestions on the 25Hours App which have been provided by third parties (e.g. Suppliers). You are deemed to be responsible for, and shall use your own skill and judgement as to, the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract with any Supplier for the supply of services or sale of goods.
 

76. In the event where 25Hours has assisted you to obtain goods or services supplied by a Supplier, your contract for the purchase of goods or services is made with the relevant Supplier only, and unless expressly provided otherwise, all your rights and remedies are against the Supplier. You agree that any contract entered into by you with any of the Suppliers is an independent contract. 25Hours hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier whether or not arranged through 25Hours.
 

77. 25Hours accepts no liability for any losses or claims arising from any inability to access the 25Hours App or any failure to complete a transaction via the 25Hours App.
 

78. Save in respect of death and personal injury caused by the negligence of 25Hours or as expressly provided for in these T&Cs, 25Hours shall not be liable for any loss, cost, expense or damage of any nature whatever including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties resulting from or arising in connection with any access to, use of, inability to use the 25Hours App, the provision of Member Benefits (including but not limited to the sale and purchase of Goods and Supplier Goods), or your reliance upon the information and suggestions within the 25Hours App.
 

79. Without affecting the generality of paragraph 78 above:

     • 25Hours shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or

       instructions supplied by you which are incomplete, incorrect or inaccurate, or arising from the late arrival or non-arrival of such requests or

       instructions, or any other fault attributable to you.

     • 25Hours shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests you place

       for non-Members.

     • In addition, non-Members shall have no cause of action directly, or indirectly via the Member or other person(s), against 25Hours for any loss,

       damage, costs, expenses or other claims for compensation arising from requests placed for the benefit of the non-Member by a Member.

     • 25Hours shall not be liable to you or be deemed to be in breach of these T&Cs by reason of any delay in performing, or any failure to perform,

       any of 25Hours’s obligations in relation to the Member Benefits, if the delay or failure was due to any cause beyond 25Hours's reasonable

       control.
 

80. In any event, 25Hours’s maximum liability to you for breach of any of its obligations under these T&Cs shall be limited to the value of the annual Membership fee and the charge for the Members Benefits to be provided.
 

81. This Section shall apply only to the extent permitted by law.

N. Governing Law and Jurisdiction

 

82. Theses T&C and all matters relating to your Membership shall be governed by the laws of Singapore and you hereby submit to the exclusive jurisdiction of the Singapore courts.
 

83. Any dispute arising out of or in connection with these T&Cs shall be governed by Singapore law. In the event of any such dispute, you agree to use your best efforts and in good faith to attempt to first resolve such a dispute with 25Hours through mediation. In the event that mediation is unsuccessful, you agree that the Singapore courts shall have exclusive jurisdiction to hear and resolve any dispute arising out of these T&C.

O. Communication on Membership Matters

 

84. You may contact 25Hours via email at membersg@25hrs.com, via telephone at 6535 7704, or via post at “25Hours International Pte Ltd 1 Raffles Place Tower 2 #38-61 Singapore 048616” on matters concerning your Membership.
 

85. When communicating with 25Hours, please ensure that such communication is in compliance with paragraph 17 of the TOU.
 

86. 25Hours may provide Members with the ability to send messages to other Members and/or post messages on the 25Hours App. Please note that 25Hours may, but shall not be obliged to, monitor, moderate, edit, or remove any or all such messages, and that Members are ultimately solely responsible for the matters which they have posted or sent. Members shall ensure that any message so posted or sent shall be in compliance with paragraph 17 of the TOU. In addition, you shall also not post any confidential information belonging to 25Hours, its parent, subsidiaries, or affiliates.
 

87. 25Hours may contact you via email, post or telephone. If you have provided us with your mobile phone number, please ensure that it is a text messaging-enabled device to receive text messages from us.

P. Waiver

 

88. The failure of 25Hours at any time to exercise, or delay on its part in exercising, any right or remedy under these T&Cs or to require performance by you or to claim a breach of any term or condition of these T&Cs shall not be deemed to be a waiver of such or any other rights or remedies available to 25Hours, nor will any single or partial exercise of any right or remedy preclude any other or further exercise thereof or the exercise of any other right or remedy by 25Hours

Q. Severability

89. If any term or condition of these T&Cs or the application of any such term or condition is held to be invalid or unenforceable by a court of competent jurisdiction, the same shall be deemed to be deleted from these T&Cs and be of no force and effect, whereas the other terms and conditions hereof shall remain in full force and effect as if such term or condition had not originally been contained in these T&Cs..

R. Whole Agreement

90. These T&C, read together with the TOU and the Privacy Policy, constitute the entire agreement between you and 25Hours regarding your Membership and the use of the services on the 25Hours App, and, unless specified otherwise, supersede and replace any prior agreements between you and 25Hours regarding your Membership.

We at 25Hours Pte Ltd (hereinafter referred to as 25Hours, the Club, us, we) take our responsibilities under the Personal Data Protection 2012 (“the PDPA”) seriously. We also recognise the importance of the personal data you have entrusted to us and believe that it is our responsibility to properly manage, protect and process your personal data.

 

25Hours operates [www.25hrs.com] and/or its subdomains (“Website”) which may be used by you to enquire about the products and services offered by 25Hours. This Privacy Policy sets out how the Club will collect, use, and disclose personal data, and the measures that the Club will have in place to ensure the security of the personal data in our possession or under our control.  By providing personal data to us, you agree to be bound by the terms of this Privacy Policy.

For the avoidance of doubt, this Privacy Policy forms part of the General Terms of Use (the “TOU”).

1. INTRODUCTION TO THE PDPA

​

1.1 “Personal data” is defined under the PDPA to mean data, whether true or not, about an individual who can be identified from that data or from that data and other information to which the organization has or is likely to have access.

 

1.2 We will collect your personal data in accordance with the PDPA. In general, before we collect any personal data from you, we will notify you of the purposes for which your personal data may be collected, used and/or disclosed, as well as obtain your consent for the collection, use and/or disclosure of your personal data for the intended purposes.

 

1.3 Your personal data may also be collected, used or disclosed if we have assessed that to do so would be in our legitimate interests and beneficial to the public.

 

Before doing so, we will take steps to ensure that any adverse effects that might arise for you have already been identified and eliminated, reduced or mitigated.

2. PURPOSES FOR COLLECTION, USE & DISCLOSURE OF PERSONAL DATA

2.1 The Club may collect, use, and/or disclose your personal data for the following purposes:

 

     a. facilitating, processing, dealing with, administering, and/or managing your purchase of our products and/or services including but not limited

         to providing confirmation of your orders and the use of your credit card information in order to complete an order;

 

     b. processing and/or administering any service or product-related inquiries, consultations, negotiations, orders, deliveries or providing customer

         support in relation to the purchase of our products and/or service;

 

     c. carrying out your instructions or responding to any enquiry given by (or purported to be given by) you or on your behalf;

 

     d. introducing and providing products and services of the Club to you;

 

     e. conducting research, analysis and development activities (including but not limited to data analytics, surveys and/or profiling) to improve our

         services and facilities in order to enhance your membership with us or for your benefit, or to improve any of our products or services for your

         benefit;

 

     f. gathering information for training and quality control purposes (including the recording of telephone calls between you and the Club);

 

     g. providing after-sales services which includes contacting you after the delivery of product to obtain confirmation of successful delivery and your

         feedback on the product;

 

     h. contacting or communicating with you for the purpose of providing booking confirmation and order confirmation.

 

     i. processing your registration and/or participation for seminars, exhibitions, and other events organised or co-organised by the Club;

 

     j. maintaining and operating the Club’s website;

 

     k. storing, hosting, backing up (whether for disaster recovery or otherwise) of your personal data, whether within or outside Singapore including

         implementing system maintenance of the Club’s databases; and

 

     l. administering security matters and/or arrangements;

 

     m. conducting customer due diligence or other screening and personal identification in accordance with laws, regulations or our risk

         management procedures that may be required by law or that may have been put in place by us;

 

     n. complying with or as required by any applicable law, governmental or regulatory requirements of any relevant jurisdiction, including meeting

         the requirements to make disclosure under the requirements of any law binding on us and/or for the purposes of any guidelines issued by

         regulatory or other authorities, whether in Singapore or elsewhere, with which we are expected to comply;

 

     o. complying with or as required by any request or direction of any governmental authority, or responding to requests for information from public

         agencies, ministries, statutory boards or other similar authorities. For the avoidance of doubt, this means that we may/will disclose your

         personal data to the aforementioned parties upon their request or direction

 

     p. processing and/or administering  requests for access and/or correction of your personal data; and

 

     q. for any other incidental purposes related to or in connection with the purposes as set out above;

 

2.2 In order to conduct our business operations more smoothly, we may also be disclosing the personal data you have provided to us to our third party service providers, agents and/or our affiliates or related corporations, which may be sited outside of Singapore, for one or more of the above-stated Purposes. This is because such third party service providers, agents and/or affiliates or related corporations would be processing your personal data on our behalf for one or more of the above-stated Purposes.

3. PURPOSES FOR COLLECTION, USE & DISCLOSURE OF PERSONAL DATA

 

3.1 You may withdraw your consent for the collection, use and/or disclosure of your personal data at any time by giving written notice to the Club. Please note that should you withdraw your consent, it may no longer be possible for us to provide you our services and products.

 

3.2 If the Club receives written notice from you that you wish to withdraw your consent, the Club will inform you on how the withdrawal of consent might affect the products and services being provided to you.

 

3.3 Please also note that the withdrawal of consent does not affect any other legal consequences arising from the withdrawal. As such, where it is no longer possible for the Club to provide services to you, your withdrawal request may result in early termination fees (only where applicable).

 

3.4 If you nevertheless confirm that you wish to withdraw your consent, the Club shall within a reasonable time cease to collect, use, or disclose the personal data. Please note that the Club may require up to 30 working days for a request for withdrawal of consent to be fully reflected in our systems.

4. COLLECTION, USE, AND DISCLOSURE OF PERSONAL DATA WITHOUT CONSENT

​

4.1 While the Club will generally only collect, use, or disclose your personal data with your consent, please note that the Club is legally permitted to collect, use, or disclose your personal data without your consent in certain situations, including:

​

     a. cases in which the disclosure is required based on the applicable laws and/or regulations;

 

     b. using your personal data for any purposes which are clearly in your interests in which consent for the collection, use or disclosure (as the case

     may be) cannot be obtained in a timely way; or you would not reasonably be expected to withhold consent;

 

     c. cases in which the disclosure is necessary to respond to an emergency that threatens the life, health or safety of yourself or another individual;

 

     d. cases in which there are reasonable grounds to believe that the health or safety of yourself or another individual will be seriously affected and

     consent for the disclosure of the data cannot be obtained in a timely way; and

​

     e. disclosing your personal data where it is necessary for any investigation or proceedings.

 

     f. The instances listed in paragraph 4.1 are not intended to be exhaustive. For an exhaustive list of exceptions, you are encouraged to peruse the

5. REQUEST FOR ACCESS OF PERSONAL DATA

​

5.1 You may contact the Club and request for access to your personal data, and the Club will, within a reasonable time, provide such access. Please note that there may be exceptional situations where your access may be limited by law or may be subject to the discretion of the Club. This includes situations where:

​

     a. access will reveal personal data of another individual; or

 

     b. personal data is subject to legal privilege.

 

5.2 The Club may, to the extent permitted by law, charge a reasonable processing fee for providing access to your personal data.

​

6. REQUEST FOR CORRECTION OF PERSONAL DATA

​

6.1 The Club will take reasonable efforts to ensure that your personal data is correct and updated.  You may at any time contact the Club to update your personal data, and the Club may also from time to time request personal data updates from you.

6.2 You may also contact the Club and request for any errors or omissions in your personal data to be corrected, and the Club will, within a reasonable time, make the necessary corrections.

6.3 Please note that there are exceptional situations where the correction of personal data may be limited by law, or subject to the discretion of the Club. This includes situations where the personal data relates to opinion data kept solely for an evaluative purpose.

7. SECURITY AND MANAGEMENT OF PERSONAL DATA

​

7.1 The Club will take reasonable steps to protect your personal data against any unauthorized access, collection, use, disclosure, copying, modification, leakage, loss, damage and/or alteration. This includes regular maintenance and upgrading of information technology security systems and other similar measures. Staff training will also be provided to ensure that employees are aware of their obligations under the PDPA.

 

7.2 However, we cannot assume responsibility for any unauthorised use of your personal data by third parties which are wholly attributable to factors beyond our control.

8. DISCLOSURE OF PERSONAL DATA TO THIRD PARTIES

 

8.1 As mentioned above the Club may disclose personal data (in whole or in part) for the purposes set out at paragraph 2.

 

8.2 The Club regularly conducts rigorous and detailed evaluations of the personal data management abilities of our third party service providers, and also exercises the necessary and appropriate supervision of such third parties to ensure that they are able to provide an adequate degree of protection over your personal data in compliance with the PDPA.

 

8.3 The Club may also, transfer, store, and/or process your personal data in a country or territory outside of Singapore. In this regard, we will take necessary measures to ensure that the overseas entity receiving your personal data is under legally enforceable obligations to provide a standard of protection to your personal data which is comparable to the level of protection under the PDPA.
